Cancellation of Your Booking by Mys Living
Mys Living may cancel your Tenancy Agreement subject to any of the following circumstances:
- We take all reasonable steps to enter into the Tenancy Agreement before the Booking Deadline and you fail to do so or the Booking Deadline has passed (for example, if you fail to complete your application or provide guarantor details (if applicable) and supporting documentation);
- We believe that you have provided us with relevant false or misleading information;
- We are prohibited from entering into the Tenancy Agreement with you because of the Immigration Act 2014 (persons disqualified by immigration status). Should we cancel your booking for this reason, you will not be liable for the contractual obligations laid out in the Tenancy Agreement from the date of cancellation, irrespective of whether you have signed it;
- You or your guarantor (if applicable) fail to cooperate with any Screening Search Additional Information Request(s) or we have determined following undertaking Screening Searches that you or your guarantor (if applicable) appear on Sanctions Lists and/or Law Enforcement Databases;
- You have not paid any amounts that have fallen due (including but not limited to, your first rental instalment, any previous year’s rent or damage charges);
- You have committed any breach of the Tenancy Agreement or any previous tenancy agreement with us.
Cancellation of Your Booking by You Prior to Your Tenancy Start Date (No Place No Pay Guarantee)
1.1 Mys Living offers a guarantee that if you do not take up your place at your chosen University then you may be released from your Booking and the obligations under your Tenancy Agreement, subject to the following conditions being met:
- You are unsuccessful in gaining a place at your chosen University due to failure to obtain grades or a visa; and
- Evidence of such (for example a letter from the University) is provided within 5 days of it being received by you; and
- Your request is accepted and approved by Mys Living thus confirming the lifting of any liability on you.
1.2. In these cases your Holding Deposit will be refunded in accordance with our refunds policy.
1.3. Where we cannot verify the authenticity of such evidence, Mys Living reserves the right to reject such a request and to enforce the terms and conditions of the Tenancy Agreement in full.
1.4. Should you wish to cancel your Booking for any reason not listed above or your request is not accepted by us, you will remain responsible for all the terms and conditions of the Tenancy Agreement.
1.5. In certain circumstances it may be possible to find a replacement tenant to take over the obligations of your agreement; this will be managed in accordance with the Mys Living tenancy assignment policy.
Requests to Cancel Your Tenancy After the Tenancy Start Date
2.1. Where your Tenancy Start Date has passed and/or you have collected keys for the property, you may only terminate your Tenancy Agreement with Mys Living in the following circumstances:
- You no longer continue to be a student at your chosen University as a result of a medical condition which was not known to you at the time of commencing your tenancy; or
- You no longer continue to be a student at your chosen University as a result of a family bereavement or circumstance which was not reasonably known to you at the time of commencing your tenancy.
2.2. In these circumstances you should make a request to the General Manager of your building in writing (via email) and include evidence of your stated reason(s) and your withdrawal from University.
2.3. All documentation and attachments must be received by us in English in order for us to consider your release from tenancy.
2.4. Upon acceptance, your tenancy release will be valid from the date two (2) weeks after the approval has been submitted to us or two (2) weeks after your release date from University, whichever is the latest.
2.5. Submission of a request and associated documentation is not a guarantee that your tenancy release will be approved and you will remain responsible for the terms and conditions of the Tenancy Agreement in full until the date your release becomes valid.
2.6. In all circumstances a replacement tenant may be identified to take over your tenancy provided such replacement is in accordance with the Mys Living tenancy assignment policy.
